Elias: CSS mit Javascript valide einfügen

Hallo

Ich füge im Head für Browser mit aktiviertem Javascript eine extra CSS-Datei ein welche bestimmte Werte aus der Gesamt-CSS überschreibt.
Und zwar so:

Funktioniert, ist aber nicht valide (XHTML1 - transitional).

Der Validator schreibt:

document type does not allow element "link" here.
...="stylesheet" type="text/css" href="menue.css">');
